Terms of Service

The short version

1. Who we are and what these terms cover

These Terms of Service ("Terms") are an agreement between you and Buzz Charts ("we", "us"). They cover the Buzz Charts desktop app for macOS (the "App"), the website buzzcharts.app and any related services (together, the "Service"). By buying, downloading, activating or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

You must be at least 18 years old, or the age of majority where you live, to buy or use the Service.

2. Purchases, billing and renewal

Reseller. Orders are processed by Creem, which acts as our reseller and Merchant of Record. Creem handles checkout, payment, sales tax or VAT and invoices, under its own terms and privacy policy. Your card statement will show Creem's descriptor for the purchase.

Subscription. Buzz Charts is sold as an annual subscription at the price shown at checkout (currently US$95 per year, plus any applicable tax). Your subscription renews automatically each year at the same price, charged to the payment method on file, until you cancel.

Price lock. If we raise the price for new members, your price stays the same for as long as your subscription stays active. If you cancel or your subscription lapses, the locked price ends, and a new subscription is at the current price.

Cancelling. You can cancel at any time from the App (Settings ▸ License ▸ Manage subscription) or by emailing support [at] buzzcharts [dot] app. Cancelling stops the next renewal; you keep full access until the end of the period you've paid for. Refunds are covered by our Refund Policy.

No free trial. We don't offer a free trial. The Refund Policy is there instead.

Add-ons. We may offer separately priced optional add-ons in the future. They will never be required to keep using what your subscription already includes.

3. Your license

While your subscription is active, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on up to 2 Macs you own or control, for your own use. You can remove a Mac from your license in Settings ▸ License to move it to another one.

The App checks your license with our license server about once a day. If it can't reach the server, it keeps working fully for 7 days. After that, or if your subscription ends, is refunded or is disputed, the App becomes read-only: your charts, saved history, layouts and drawings stay available, but live data, dealer maps (GEX/VEX), Buzz AI and new alerts pause until the license is active and checked again.

We own the App and the Service, including all updates. Open-source components included in the App are licensed under their own licenses, listed in the App under Help ▸ Third-Party Notices; nothing in these Terms limits your rights under those licenses.

4. Your own data and AI keys

The App does not include market data or AI. You connect your own accounts: a broker or market-data provider for prices and options data, and optionally an AI provider for Buzz AI. You may also use built-in sample data.

Provider names in the App and on our website are used only to identify what the App can connect to. They don't mean that a provider endorses, sponsors or partners with Buzz Charts.

5. Not financial advice

Buzz Charts is software for charting and visualizing market and options-positioning data. It is not investment, financial, legal or tax advice, and nothing in the Service is a recommendation or solicitation to buy, sell or hold any security or other asset. We are not a broker-dealer or investment adviser, and the App does not place or route orders.

Dealer maps (GEX/VEX), levels such as KING, GATE and FLOOR, paths, alerts, scripts, backtests and Buzz AI answers are estimates from models and third-party data. They rely on assumptions that may not hold, and they can be wrong, incomplete or delayed. Past or simulated results don't guarantee future results. Trading involves substantial risk of loss. You are solely responsible for your own trading and investment decisions.

Alerts are only checked and sent while the App is running and connected, and delivery through notifications, Telegram, Discord, ntfy, webhooks or other services can fail or be delayed. Don't rely on them as your only way of managing risk.

6. Your content

Your scripts, layouts, drawings, watchlists, notes and settings ("Your Content") belong to you and are stored on your Mac. We don't claim any rights in them. You're responsible for having the right to use any scripts or other material you import. Pine Script® is a registered trademark of its respective owner; Buzz Charts runs Pine-compatible scripts and is not affiliated with that owner.

7. Updates and changes to the Service

We may update, improve or change the Service, including adding or removing features or data-provider integrations (for example, if a provider changes its API). We won't remove core charting features from an active subscription during the period you've paid for without offering a pro-rated refund for that period.

8. Suspension and termination

You can stop using the Service and cancel at any time. We may suspend or end your license if you materially break these Terms (for example by sharing your key or bypassing the license check), if a payment is reversed or disputed, or if required by law. If we end your license for a reason other than your breach, we'll refund the unused part of your current subscription period. Sections 4 to 6 and 9 to 13 continue after your license ends.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE OR ANY DATA WILL BE UNINTERRUPTED, TIMELY, ACCURATE OR ERROR-FREE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOST DATA OR LOST OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not fully apply to you.

11. Indemnity

You agree to cover our reasonable losses and costs from third-party claims arising out of your breach of these Terms or your use of a third-party provider's data, API or services in breach of that provider's terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts in Los Angeles County, California, and you and we consent to their jurisdiction. Before filing a claim, please email support [at] buzzcharts [dot] app so we can try to resolve it informally. Nothing here limits any rights you have under the consumer-protection laws of the place you live.

13. General

These Terms, our Privacy Policy and our Refund Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, that isn't a waiver. You may not transfer these Terms; we may transfer them as part of a sale or reorganization of the business. We may update these Terms; if a change is material, we'll post it here and tell you in the App or by email before it takes effect, and it will apply from your next renewal unless the law requires otherwise.
